Criminal
Law

Criminal law is part of public law that encompasses the legislations which punish acts defined as criminal and for which there is a judicial consequence.

Criminal Law

When a person is charged for breaking the law or rather when a person is a victim of a crime, an expert needs to be at hand.

When someone is suspected of committing a crime, they are asked to choose the lawyer’s address for service. At that precise moment, they are aware that the authorities are carrying out an investigation against them, even if for the time being the relative documents cannot be known. Only with the law 415bis (the order for the committal for trial) will the defender be able to access the documents and set up a suitable defense and assess if and how to arrive at the trial.

To face a criminal trial both as an accused party and as a victim, it is imperative to employ a lawyer who not only knows the topic, but who also has a great deal of experience in the matter. Therefore, together with the expert rooted in the acts, an adequate trial can be carried out.

The regulation foresees the possibility that even the victims of a crime, if they wish can also be assisted by a lawyer who actively takes part in the investigation. The defense will help the victim to assess whether or not it would be possible to be a civil part in the criminal process when it comes to a hearing.

Red
Code

A law to defend women so as to avoid family abuse turning into femicide. Not only a tool to help women, but also concrete support.

The Red Code (Law 19 July 2019, n. 69) was created to protect the victims of domestic and/or gender-based violence. The law provides a preferential procedure for this type of crime using terminology and AandE (Accident and Emergency) protocols for any serious cases. Even if there is still room for improvement, it is proof of the attention the law has towards this type of crime.

Cristiana Arru guarantees specific protocols are applied to assist women who have been abused, with the aim of stopping the violence degenerating into femicide. The first step to be taken is securing the victim is in a safe place, always working with public officials, and all powers of attorney as well as the police, specialized in this kind of matter. It is fundamental to follow the victims appropriately on the one hand, as well as the accused party on the other, as both have the right to be defended by the law.
